3 NPA rebels killed, 3 soldiers injured in Zamboanga del Sur clash

ZAMBOANGA CITY, Philippines—Three communist rebels were killed while three soldiers were injured in a clash in Tigbao, Zamboanga del Sur around 2:45 p.m. Wednesday, a report reaching the military’s Western Mindanao Command (Westmincom) based here, said. 

In that report, sent by the 4th Scout Ranger Battalion, soldiers were patrolling Barangay Mati in Tigbao when the clash took place. 

As a result, three New People’s Army rebels had been killed and their firearms recovered, the report added.

The whole revolutionary movement in the Province of Rizal led by the NDFP-Rizal vehemently condemn the brazen violation by the Armed Forces of the Philippines (AFP) of the synchronized declaration of ceasefire between the CPP-NPA-NDFP and the  AFP-PNP-GPH from  December 20, 2012 until January 15, 2013. While the revolutionary movement seriously implemented the ceasefire, the AFP troops disregarded and brazenly violated their own declaration of  Suspension of Offensive Military/Police Operation (SOMO/SOPO). This forced the NPA-Rizal to engage in battle and fought the AFP attacking troops to defend themselves.

The Moro Islamic Liberation Front (MILF) has been mum on the criticisms hurled against it by the Communist Party of the Philippines (CPP). We know it is not beneficial to both organizations if they are dragged into the verbal tussle.  However, it is not good either if the MILF allows the one-way verbal assault continues.   There must be a brake to it by way of this explanation.

AND INTERNATIONAL HUMANITARIAN LAWS




Comprehensive Agreement on Respect for Human Rights and International Humanitarian Law Between the Government of the Republic of the Philippines and the National Democratic Front of the Philippines.

THE GOVERNMENT OF THE REPUBLIC OF THE PHILIPPINES, including the executive department and its agencies, hereinafter referred to as the GRP AND THE NATIONAL DEMOCRATIC FRONT OF THE PHILIPPINES, including the Communist Party of the Philippines (CPP) and the New People's Army (NPA), hereinafter referred to as the NDFP Hereinafter referred to as "the Parties",



PREAMBLE

RECOGNIZING that respect for human rights and international humanitarian law is of crucial importance and urgent necessity in laying the ground for a just and lasting peace,

CONSIDERING that a comprehensive agreement on respect for human rights and international humanitarian law should take into account the current human rights situation in the Philippines and the historical experience of the Filipino people.

AFFIRMING that the principles of human rights and the principles of international humanitarian law are universally applicable,

ACKNOWLEDGING that the prolonged armed conflict in the Philippines necessitates the application of the principles of human rights and the principles of international humanitarian law,

REAFFIRMING their continuing commitment to the aforesaid principles and their application,

REALIZING the necessity and significance of assuming separate duties and responsibilities for upholding, protecting and promoting the principles of human rights and the principles of international humanitarian law,

UPHOLDING and complying with the mutually acceptable principles as well as the common goals and objectives in The Hague Joint Declaration of September 1, 1992, the Breukelen Joint Statement of June 14, 1994 and pertinent joint agreements hitherto signed, and

FULLY AWARE of the need for effective mechanisms and measures for upholding, protecting and promoting the principles of human rights and the principles of international humanitarian law in a comprehensive agreement,

SOLEMNLY ENTER without reservation into this Comprehensive Agreement on Respect for Human Rights and International Humanitarian Law.




PART I
DECLARATION OF PRINCIPLES

Article 1
The Parties are governed by the framework of holding peace negotiations under mutually acceptable principles of national sovereignty, democracy and social justice and under no precondition that negates the character and purpose of peace negotiations, as stipulated in The Hague Joint Declaration (Paragraph 4) and reaffirmed in the Breukelen Joint Statement (No. 7 of II) and subsequent agreements.

The Communist Party of the Philippines (CPP) predicted that newly appointed AFP chief of staff Lt. Gen. Emmanuel Bautista will end his term in frustration as he is bound to fail miserably in his declared objective of "rendering irrelevant" the New People's Army (NPA) in the next few years. Bautista is widely regarded as the author of Oplan Bayanihan, the current counterinsurgency operational plan of the AFP.

"General Bautista cannot stop the momentum of growth of the New People's Army," said the CPP.

UN on int’l interfaith understanding

(January 8-15)
The United Nations has approved during its 57th Plenary Session on December 18 a Philippine-sponsored resolution seeking interfaith and intercultural understanding and cooperation around the world.

Pakistan co-sponsored the resolution, which was adopted and supported by 51 member states.  The resolution improves on earlier UN resolutions seeking to promote greater tolerance and harmony among people of different cultures and religions around the world during the International Decade for the Rapprochement of Cultures (2013-2022).

New Year's Message of GPH Chair Miriam Coronel Ferrer: "Finish what we began"

We in the Government Negotiating Panel for Talks with the Moro Islamic Liberation Front (MILF) enter 2013 with the conviction to finish what we have begun together with the MILF.

The will and the goodwill are there to make this happen. The two negotiating partners, the Bangsamoro, the peoples of Mindanao, the Filipino public and the international community all want this peace process to succeed.  With this much public support, how can we not reach our goal?

It took some two years to achieve the set of consensus that now make up the Framework Agreement on the Bangsamoro (FAB). The difficult issues were set aside for the annexes.  Only in December did we begin work on a fourth annex.

Still, the GPH and the MILF are way past the mid-way mark after meeting only twice since the signing of the FAB on 15 October 2012. There has been much progress both in the substance and in the ‘languaging’ of the texts.

For one, there has been important breakthrough in coming to terms with the principles that will guide the “intergovernmental relations” between the Central and Bangsamoro governments and constituent parts.

An example is the principle to settle conflicts in laws, programs or policies in a non-adversarial manner. This way harmony is maintained between and among the parts not only under the P-Noy administration but also under all future national administrations.
The three lists defining the allocation of powers – reserved to the Central government, devolved or exclusive to the Bangsamoro, and concurrent – are almost complete. They make up the bulk of the Annex on Power-sharing.

Only about four power-sharing issues remain to be discussed. These remaining issues are substantial and rather technical. The parties have agreed to solicit advice from technical experts to help them find workable solutions.

There is a working consensus on a new and better sharing formula in relation to government revenues derived from the exploration and utilization of natural resources.
This wealth-sharing formula, a set of devolved taxes, and the system of block grants reflect the mutual desire of the two parties to achieve sustainable self-governance and fiscal autonomy for the Bangsamoro.

Soon, the GPH and MILF panels will be presenting to the public a jointly produced road map that shall serve as the official guide to the implementation of the FAB.
There are many more consensus points in the current draft annexes. These will be openly discussed in due time.

More importantly, both parties are open to consider options on the remaining eight or so issues, across the annexes, including the “technical impasse” pertaining to the Bangsamoro Transition Authority.

We firmly believe that there is no deal-breaker in this process, in which much trust and effort have been invested, and for which much more support will be given.
It should not take more than two months to finish the four annexes.  By this time, the Transition Commission should have been fully organized and ready to build on the terms laid out by the Panels in the Annexes.
The future is on track.

Kinukundena ng Partido Komunista ng Pilipinas (PKP) ang rehimeng Aquino sa paglulunsad ng malawakang opensiba at sa pagtatalaga ng mga armadong tropa nito laban sa mga rebolusyonaryong base at sa Bagong Hukbong Bayan sa kabila ng pansamantalang sabayang tigil-putukan sa pagitan ng National Democratic Front of the Philippines (NDFP) at ng Gubyerno ng Republika ng Pilipinas (GPH).

Batay sa mga ulat mula sa mga kumand ng Bagong Hukbong Bayan sa mga erya, may lumilitaw na padron ng paunang pagpapakat ng tropa ng Armed Forces of the Philippines (AFP) at ng mga espesyal na pwersa ng pulisya na malinaw na paghahanda para sa isang todo-todong opensiba sa pagtatapos ng kasunduan sa tigil-putukan sa Enero 15.

Tinutuligsa ng PKP ang mapanlansing pahayag ng Malacañang at ng AFP na nagsasabing matapat nilang sinusunod ang kasunduan para sa pansamantalang sabayang tigil-putukan habang isinasagawa ang mga opensibong operasyon sa tabing ng tinaguriang mga operasyong "peace and order". (Tingnan ang pinakahuling ulat sa ibaba.) Halatang-halata na sinasamantala ng AFP ang tigil-putukan upang buong-layang isagawa ang malawakan at malakihang operasyon dahil batid nilang magpipigil ang mga yunit ng BHB sa paglulunsad ng mga kontra-atake bilang pagtalima sa pansamantalang kasunduan ng tigil-putukan.

Ang patuloy na mga operasyong kombat, pagtatalaga ng mga tropa, militarisasyon at pagpapaigting ng operasyong paniktik sa mga komunidad sa kanayunan ay bahagi lahat ng pinaigting na kontra-rebolusyonaryong opensiba ng rehimeng Aquino ngayong taon. Bahagi lahat ito ng kapanyang panggerang Oplan Bayanihan nito upang wasakin ang Bagong Hukbong Bayan sa kalagitnaan ng taon, at ipasa ang tinaguriang mga operasyong counter-insurgency mula sa AFP tungo sa Philippine National Police (PNP).

Matingkad na naiiba sa todong paglapastangan ng AFP sa pansamantalang sabayang tigil-putukan, ang lubos na pagtalima ng mga yunit ng Bagong Hukbong Bayan at milisyang bayan sa kautusan ng Komite Sentral na ihinto at umiwas sa pagsasagawa ng mga operasyong opensibo. Pawang walang batayan at kasinungalingan ang mga bintang na paglabag ng BHB sa deklarasyon ng tigil-putukan ng PKP na inimbento ng AFP sa pamamagitan ng mga utusang-US na tagalubid ng kasinungalingan. Ulat ng mga opensibong operasyon ng AFP na paglabag sa kasunduan sa sabayang tigil-putukan

1. Simula Disyembre, ginagalugad ng mga elemento ng 57th at 40th IB ang mga baryo ng Old Bulatukan, New Israel at Biangan, pawang sa Makilala, North Cotabato at ipinwesto ang dalawang kanyong 105 howitzer na nakatutok sa Larangang Gerilya 51 at 72 ng BHB.

2. Nagtalaga ng tatlong seksyon ng sundalo ang 10th ID sa bawat barangay sa pagitan ng Mapula hanggang Barko-barko, Lumiad hanggang Riverside at sa Pandaitan, lahat sa Paquibato District, Davao City.

3. Nagtayo ng mga teskpoynt ang 10th ID sa mga daan patungong Paquibato upang pigilan ang mga bisita na makadalo sa mga pagtitipong masang nakatakda upang gunitain ang anibersaryo ng PKP noong Disyembre 26.

4. Patuloy na sinisindak ng mga elemento ng 69th IB at 84th IB ang mga residente ng Purok Isled, Barangay Damilag sa Calinan, Davao City upang pwersahin silang iulat ang kinalalagyan ng mga lokal ng yunit ng BHB.

5. Inaresto ng mga elemento ng 74th IB ang limang lokal na magsasaka noong Disyembre 21 sa Mulanay, Quezon at inakusahan silang mga kasapi ng Bagong Hukbong Bayan (BHB).

6. Inaresto noong Disyembre 25 ng mga elemento ng 302nd Brigade at lokal na pwersa ng pulisya sa Manjuyod, Negros Oriental si Oligario Sebas, na inakusahan ng militar na si Felimon Mendrez na diumano’y mataas na lider ng rebolusyonaryong kilusan.

7. Inaresto ng mga elemento ng Cagayan Valley Regional PNP noong Disyembre 28 sa Bagumbayan, Tuguegarao City si Rene Esmondo Abiva na pinagbibintangan din ng militar na diumano’y rebolusyonaryong lider.

8. Noong Enero 1, pinasok ng tatlong platun ng 84th IB ang Barangay Tambobong, Baguio District, Davao City at nag-operasyon sa lugar. Noong Enero 3, pinalaki pa ang pwersa mula sa ibang tropa, pwersahang pinalikas ng 84th IB ang 125 pamilya, pinagbawalan ang pagtatrabaho sa mga plantasyon at kinontrol ang paghahatid ng bigas at iba pang pagkain sa lugar.

9. Ilang oras bago mag-Disyembre 16, sa pagsisimula ng deklarasyon ng tigil-putukan ng rehimeng Aquino, palihim na pinasok ng isang platun ng 31st Infantry Battalion ang Barangay Hamorawon, Bulan, Sorsogon. Sa loob ng ilang araw, sinuyod nito ang mabundok na lugar hanggang sa may hangganan ng mga bayan ng Bulan at Irosin, bago bumalik sa kanilang kampo.

10. Naglunsad ng operasyong kombat ang mga elemento ng PNP Regional Public Safety Battalion (dating Regional Mobile Group o RMG) sa Barangay Macahoy, San Pascual, Masbate noong Disyembre 24 at 25. Noong Disyembre 28 at 29, niryed ng tropang ito ang bahay ng isang pamilya ng magsasaka sa Barangay Mabini na pinaghihinalaang aktibo sa rebolusyonaryong kilusan.

11. Noong Disyembre 23, dinukot ng mga elemento ng PNP Milagros, Masbate City at ng mga tropa 9th Infantry Battalion sina Olalio Gonzaga, 32, ng Barangay Bolo, Masbate City at si Noel Espinosa, 37, isang barangay tanod sa Barangay Miabas, Palanas, Masbate.

12. Noong Enero 2, pinasok ng mga elemento ng 2nd IBPA ang Barangay Sta. Cruz, Donsol, Sorsogon at naglunsad ng operasyong kombat laban sa Bagong Hukbong Bayan at mga rebolusyonaryong organisasyong masa sa lugar.

13. Patuloy na naglulunsad ng mga tinaguriang "peace and development teams" ng AFP ang paniniktik at operasyong saywar sa humigit-kumulang 40 barangay sa Bicol.

January 1, 2013 News: The Coordinating Committee on the Cessation of Hostilities(CCCH) of the Government of the Philippines (GPH) and the Moro Islamic Liberation Front (MILF) had a record of zero incident of armed encounter between the government and MILF forces in 2012.

The GPH and MILF CCCH, popularly known as the ceasefire committee, relayed this    report to luwaran this new year' day.

"2012 is indeed a historic year for the current GPH - MILF Peace Process as it is the     only year since the signing of the ceasefire accord between the two parties more than     a decade of years now that not a single encounter of armed encounter between government and MILF forces occurred, “conveyed the Secretariat of the GPH -MILFCCCH.

Last October 15, 2012, the peace negotiating panels of the government and MILF and    the Malaysian Third Party Facilitator signed the historic GPH -MILF Framework            Agreement on the Bangsamoro at the Presidential Palace in Malacanang.

Standing as principals witnesses in the signing of the Framework Agreement on the      Bangsamoro were President Benigno Simeon Aquino III, Malaysian Prime MinisteDato' Sri Mohd Najib bin Tun Haji Abdul Razak, and MILF Chairman Al Haj Murad Ebrahim.
The effective ceasefire mechanisms of the peace process on the ground such as the GPH- MILF CCCH headed by BGen Gilberto Roa and Said Shiek, GPH - MILF AHJA       Guided by BGen Roland Amarille and Atty Abdul Dataya, tne local monitoring teams(LMTs), and the International Monitoring Team headed by His Excellency MGenDatuk Abdul Rahim bin Yusuff of Malaysia with members from Brunei, Japan,Indonesia, Norway and the European Union were very significant in the successful realization of the Framework Agreement on the Bangsamoro.

Maj Carlos Sol Jr, Head of the Secretariat of the GPH CCCH, said "the effectiveness of the ceasefire mechanisms and strong cooperation and partnership between the government and MILF forces attributed the zero armed encounter for 2012."

"The signing of the Framework Agreement had significantly improved and sustained the adherence and support to the ceasefire particularly among the ground commanders of
the government and MILF and the local government units," Maj Sol said.

MGen Datuk Abdul Rahim, IMT Head of Mission, commended the GPH - MILF CCCHand the other ceasefire mechanism for the remarkable accomplishment in 2012.
He urged both the government to keep the zero incident in 2013 and maintain the
Stable situation on the ground so that the implementation of the Framework Agreement will be provided the necessary conducive environment for its greater success.

It is unfortunate that the CPP/NPA/NDF is interested in looking for excuses to resume violence than it was to seek peace.

In a statement issued by the CPP today upon recommendation of the Negotiating Panel of the NDFP, the CPP declared an end to its self-imposed ceasefire on January 2 and cited as an excuse the “failure of the GPH to comply with the agreement last December 17-18 to extend its own ceasefire order to January 15."

This is a false claim as shown by the explicit provision of the Press Communique issued by the Norwegian Facilitator, the statement of Secretary Deles issued on December 20 affirming the extended ceasefire declaration, and the procedural processes undertaken by the security forces to officially affirm the extension of the SOMO and SOPO that led to its formal announcement by the Armed Forces of the Philippines and the Philippine National Police this afternoon, January 2.

The said announcement was in keeping with the official communication of the GPH to the Norwegian Facilitator sent during the holiday break that reiterated our assurances of the announcement of the extension of the SOMO and SOPO before the original unilateral declaration lapses.

In their statement, the CPP also made another excuse saying that they did not want “to be placed in an unduly disadvantaged position when the AFP ends its suspension of military offensives by midnight tonight.” Since the time that Government made the ceasefire declaration, there have been no recorded violations by the military and police, which is a clear manifestation of our commitment to honor the ceasefire agreement.

Government stands firm to the nationwide ceasefire agreed upon with the NDF which commenced on December 20, 2012 and will remain effective until January 15, 2013. Our security forces will maintain its unilateral declaration of SOMO and SOPO, despite the CPP’s termination, and will stand ready to defend and protect our people. ##

Palace welcomes ceasefire ‘re-extension’ by communist insurgents

Malacanang welcomed the re-extension of the ceasefire by communist rebels until January 15 this month noting that this will benefit combatants on the ground.

“The Central Committee of the Communist Party of the Philippines (CPP) has declared a re-extension of the ceasefire to January 15, 2013. The government welcomes this change of heart from their earlier position. This gives our soldiers and members of the CPP-NPA-NDF more time with their loved ones, which becomes difficult in times of conflict,” Presidential Spokesman Edwin Lacierda said in a statement on Thursday.
“Despite unilateral statements to the contrary, the government is fully committed to honoring this ceasefire—a clear indication of our sincerity and determination to maintain peace and stability.”

Representatives from the government and the Communist Party of the Philippines-New People’s Army-National Democratic Front (CPP-NPA-NDF) met in The Hague, Netherlands, last month and agreed on a holiday truce that would last from December 20, 2012 to January 15, 2013.

Lacierda also said the Aquino administration is looking forward to resuming a fruitful dialogue with the CPP-NPA-NDF, with the vision of fostering a true and lasting peace in the country.

The rebel group cut short its declared ceasefire with the government this week. Instead of January 15, ceasefire ended effectively Wednesday.

The CPP-NPA-NDF said it had shortened the duration of the ceasefire because President Benigno S. Aquino III failed to issue a reciprocal declaration indicating said ceasefire would end on January 15.

The Central Committee of the Communist Party of the Philippines (CPP) today reextended its ceasefire declaration to January 15 after the Aquino regime belatedly announced yesterday its own suspension of military operations.

The CPP-CC issued the following declaration:

The Central Committee of the Communist Party of the Philippines hereby declares to all commands and units of the New People's Army (NPA) and the people's militias that the end of the ceasefire declared on December 20 has been reextended to 2359H of January 15. Specifics of the December 20 order will remain valid for the duration of this order. This declaration overrides an earlier order by the CPP-CC abbreviating the ceasefire to 2359H of January 2.

This declaration is being issued upon recommendation of the National Democratic Front of the Philippines (NDFP) after being belatedly informed of the formal order by the president of the Government of the Republic of the Philippines (GPH) Benigno Aquino III extending the suspension of offensive military and police operations of the Armed Forces of the Philippines (AFP) and the Philippine National Police (PNP).

According to the CPP, the Aquino government did not promptly order the extension of its earlier suspension of offensive military and police operations. As shown by the fascimile of Aquino's order, the recommendation by the Secretary of National Defense was forwarded only yesterday noon, two weeks after the agreement was forged and a few hours after the CPP order abbreviating the ceasefire was made public.

Over the past two weeks, the GPH representatives refused to answer several communications seeking compliance with the December 20 to January 15 synchronized temporary ceasefire. The correspondences were sent by the NDFP Negotiating Panel directly and through the Royal Norwegian Government third-party facilitator.

"The CPP hopes that the reextension of the ceasefire order will help push forward peace negotiations between the GPH and the NDFP. The GPH, however, still has a lot of work to do in terms of compliance and rectification of violations of previous agreements, including the release of detained peace consultants in accordance with the Joint Agreement on Safety and Immunity Guarantees (JASIG) and the release of more than 400 political prisoners in compliance with the Comprehensive Agreement on Respect for Human Rights and International Humanitarian Law."

At the same time, the CPP denounced the continued military operations of the AFP despite Aquino's ceasefire order. "Aquino's ceasefire order has been reduced to a meaningless piece of paper due to the AFP's continued offensive military operations against the people and their revolutionary forces in various parts of the country," said the CPP.

BLMI, MinHRAC conduct training for Pool of Speakers on FAB

January 1, 2013 News: The Bangsamoro Leadership and Management Institute (BLM) and the Mindanao Human Rights Action Center (MinHRAC). in collaboration with Bangsamoro Study Group (BSP) under the auspices of The Government of Norway, conducted a one-day Training-Workshop for Pool of Speakers on Framework Agreement on The Bangsamoro, which was held at BLMI Training Center in Crossing Simuay, Sultan Kudarat, Maguindanao last October 30.


The said training-workshop was hosted by MinHRAC, whose main office is in Cotabato City, in partnership with the BLMI, whose main mandate is to train young Moro leaders in the field of leadership and management.

Participants came from most of the provinces in Mindanao, namely Tawi-Tawi, Sulu, Basilan Sibugay, Zamboanga del Norte, Zamboanga City, Zamboanga del Sur, Lanao del Sur, Maguindanao, North Cotabato, Sarangani Province, Compostela Valley and Davao Oriental.
The facilitating team was led by no less than Atty. Zen Malang, Executive Director of MinHRAC, and was ably assisted by Atty. Naguib Sinarimbo, the Secretary General of the Bangsamoro Study Group (BSG).

The BSG consolidated the output of the workshop presentation.

According to Malang, there were five fundamental reasons for this training, as follows: 1. The acceptability of the Framework Agreement on the Bangsamoro, 2. To have clear understanding of the Framework Agreement on the Bangsamoro, 3. To increase the number of speakers to reach the greater number of audiences. 4. To increase the number of speakers who could speak different or various dialects and languages. 5. To standardize the level of understanding of FAB by sticking to the content of the FAB and never to exaggerate nor reduce it.

The resource speakers were members of the MILF peace panel headed by its Chair Mohagher Iqbal. Prof. Abhoud Syed Lingga and Atty. Michael Mastura were also present.
Iqbal stayed briefly, because he had another meeting in another place.

Prof. Syed Lingga stressed that the FAB should be explained in the proprer context including the historical setting and it should be read and explained articles by articles, so that the audience will not be bored

He further said the presentation of the provisions of the FAB should be simple, so as to avoid confusion among the audience.

“Stick to technical terms, no additions nor deductions,” Malang admonished the participants.

In the afternoon session, Mastura handled the topic on “how to handle difficult questions”., while Sinarimbo made the wrap-up of the training.
