NPA must surrender Davao blast suspects, says peace talks monitoring team

The government committee tasked to monitor the peace negotiations with communist guerrillas has denounced the refusal of the New People’s Army (NPA) to surrender the suspects behind the grenade attack in Paquibato District, Davao City that injured 47 persons, mostly children.

In a statement, the Government of the Philippines Monitoring Committee (GPH-MC) said true and impartial justice demands that the NPA must surrender and subject the perpetuators of the grenade attack to the Philippine justice system.

The statement said the NPA’s admission that the attack was a mistake and its subsequent payment of P5,000 to each of the 47 victims “would not be sufficient to give the victims, many of whom were children, true justice.”

The GPH-MC statement echoed an earlier statement of lawyer Alex Padilla, chairman of the government peace panel dealing with the communist rebels, who decried the indemnification offer and said it was a mere “stopgap and diversionary measure."
“The NPA has long maintained that its forces are well-versed in Human Rights and International Humanitarian Law (HR-IHL),” the GPH-MC statement said. “In signing the Comprehensive Agreement on Respect for Human Rights and International Humanitarian Laws (CARHRIHL) through its political entity the National Democratic Front (NDF), the NPA has in effect held itself accountable to these standards.”

“If it were truly a champion of human rights and international humanitarian law, the NPA would readily surrender [the rebel] perpetrators of the Paquibato bombing and their other HR-IHL crimes to the Philippine justice system, which, however imperfect, remains a far better legal remedy to HR-IHL stakeholders and to the public than the ‘justice system’ of  the NPA,” the statement added.

The NPA had earlier said they would deal with the matter in their own justice system, which, the GPH-MC said, “has never been transparent—open to the public, the media, nor the government.”

Responding to the rebel group’s statement denouncing the government’s system of justice and accountability, the GPH-MC said “The NPA’s refusal to submit themselves to the Philippine justice system, does not change the fact that the group is not above international HR and IHL principles and laws, which they and their legal entity, the NDF, continually invoke when they allege violations” by the government’s security forces.
The GPH-MC is the counterpart of the National Democratic Front-Monitoring Committee. Both committees form the Joint Monitoring Committee, an entity that oversees and ensures compliance to CARHRIHL.

Padilla said the “reckless action raised by the NPA is simply not acceptable and such uncivilized and irresponsible act is a grave violation of human rights and will not lead to any meaningful resolution” to issues being raised by the Communist rebels.
“If the group sincerely wants to put a solution to the country’s problems, the rightful way would be to go back to the negotiating table with the government and exhaust ways on how to work together in reaching just and lasting peace,” Padilla said.

Last September 1, the NPA’s Merardo Arce Command of Southern Mindanao admitted its operatives threw a grenade at a fiesta gathering in the Paquibato District in Davao City.
In a statement to media, the NPA claimed the grenade was intended for a nearby military detachment but was mistakenly lobbed into a civilian crowd gathered for a circus performance. Forty-seven civilians, many of them children, were gravely injured in the explosion.

AFP Welcomes 1.42 Billion for Camp Projects

AFP Welcomes 1.42 Billion for Camp Projects

CAMP GENERAL EMILIO AGUINALDO, Quezon City – The Armed Forces of the Philippines (AFP) welcomes the administration’s recent move to shape up the military’s camp by releasing a P1.42-Billion fund to the AFP General Headquarters through the Department of Budget and Management (DBM).

DBM said that the total fund release will be used to support various military camp upgrade initiatives, including Architectural and Engineering upgrades amounting to P1.14 billion. Included as well in the release is the amount of P282 million for the construction of a Combined Arms Readiness Training Center, as well as P594,000 for Training and Doctrine Command Projects, among others.

The AFP leadership deems the fund release advantageous in its efforts to expedite the implementation of the military camp and facilities improvement projects, which are included in its Bases and Support Systems Development (BSSD) Programs.
The BSSD is one of the AFP Modernization and Capability Upgrade Program’s five interlocking components which include Force Restructuring and Organizational Development, Doctrines Development, Human Resource Development and Capability, Materiel and Technology Development.

More Support from BCDA through Bases Development

Meanwhile, Bases Conversion and Development Authority (BCDA) President, Arnel Paciano Casanova vowed to intensify its continued support to the AFP Modernization and Capability Upgrade Program by outlining potential fund-generating projects to benefit the military. He continues to touch base and further reach out to military personnel in numerous speaking engagements and dialogues.

Casanova discussed opportunities for several AFP camps in the recently concluded Public Affairs Seminar/Workshop held at the Philippine Army Headquarters in Fort Bonifacio last September 14. He addressed the Spokesperson of the Philippine Army and other talking heads of the different Army divisions about the foreseen comprehensive development program for Fort Magsaysay Military Reservation in Nueva Ecija. There are still other areas for development that must be studied. This will ensure the proper utilization of idle military lands and is aimed at maximizing the potential of the large tracts of land located within AFP bases and camps nationwide.

The BCDA president also enlightened Philippine Army Public Affairs Officers about the BCDA's role in the AFP modernization.

"As of June 2012, the AFP share in the BCDA's Asset Disposition Program amounts to P 21.788 billion. The fund has been remitted to the National Treasury, which the AFP can tap for the modernization program. We will continue to contribute to the protection of our national security by supporting the AFP Modernization Program and providing assistance in base development planning," Casanova said.

The AFP has been continuously receiving assistance and support from the BCDA as contribution to the implementation of the AFP Modernization and Capability Upgrade Program.

Aside from the shares received in the disposition of lots, the military is also receiving share from non-sale transactions like the JUSMAG Replication Project as reflected by the residential condominium buildings turned over to the Philippine Army, Philippine Air Force and Philippine Navy. The replication program is a P700-million project which aims to provide the AFP with 12 residential condominium buildings. Currently, the state agency has already turned over six condo buildings and is set to complete the other six by the end of the year.

Significant Development for AFP Camps

The most recent release from DBM and the continued BCDA’s contributions come as significant development for the improvement of our military camps facilities which encompass the housing of our military officers within Camp Bonifacio in Taguig and Villamor Air Base in Pasay.

The AFP believes that aside from procuring weapons systems and acquiring other military hardwares, the enhancement of our camp’s administrative and training facilities within our military bases is equally important. Such upgrade will surely boost military personnel’s readiness and morale enabling a better prepared and much capable military organization.
“We are ever grateful for the continued care and concern of the government to the AFP. It is looking after our soldiers’ welfare by continuously providing the troops a more comprehensive support system and quality training facilities which will significantly contribute in proficiently fulfilling our sworn mandate,” AFP Chief of Staff General Jessie D. Dellosa said.

The persistence of military rule in the country

From the Website of CPP/NPA/NDF

The persistence of military rule in the country

ANG BAYAN
21 September 2012

Military terrorism persists in the country. Military rule remains a reality 40 years after Ferdinand Marcos' formal declaration of martial law on September 21, 1972 and 26 years after his regime was overthrown in a people's uprising in February 1986.

Marcos used martial law to perpetuate himself in power and strengthen the rule of foreign big capitalists, big bourgeois compradors, landlords and bureaucrat capitalists.

Despite the much-vaunted restoration of democracy, there is little to distinguish succeeding regimes from the despised Marcos fascist dictatorship. Even without a formal martial law declaration, state terrorism is able to prevail. The exploiters and oppressors backed up by martial law continue to lord it over.

This has been made possible through the intensified militarization of the country since the time of Corazon Aquino's regime up to that of her son Benigno Aquino III. The current regime bears the notoriety of launching massive and incessant military operations and maintaining a heavy military presence in peasant and urban poor communities nationwide.

To preserve the rotten and bankrupt semicolonial and semifeudal system, the Armed Forces of the Philippines (AFP), the Philippine National Police (PNP) and other armed minions of the reactionary state have been expanded and given major roles to play since 1972. The AFP's ascendance in many aspects of Philippine society is a manifestation of the continuously worsening crisis of the ruling system, which has made it necessary to strengthen the coercive forces of the state and suppress the people's growing resistance.

Marcos beefed up the AFP from 60,000 to 100,000 troops upon the declaration of martial law and further expanded it to 250,000 in mid-1975 after integrating the forces of the PC-INP. After martial law, the AFP's size further swelled to 200,000 and the PNP from 115,000 to its current size of 140,000. These figures do not include paramilitary forces like the CAFGU and other armed groups controlled by the military whose numbers have also grown severalfold.

The AFP not only serves as the strongest bastion of the reactionary ruling system. It is also US imperialism's most reliable instrument for ensuring its dominance over the country. The AFP is the US' most unflinching ally in the protection of its strategic interests in the Philippines and in stabilizing the reactionary political system, safeguarding foreign investments and suppressing the anti-imperialist and revolutionary forces. Towards this end, US imperialism has taken tremendous efforts to strengthen the AFP's organization, supply it with weapons and train its personnel on current US doctrine.

The AFP and PNP, in fact, trace their origins to the first mercenary troops from Macabebe, Pampanga who were used by the American colonialists to pursue Filipino revolutionaries resisting US occupation troops from 1899-1903. These forces later evolved into the Philippine Scouts (which later became the Philippine Scout Rangers) and the Philippine Constabulary.

Key officers of the AFP are sent for training to US military institutions such as West Point Military Academy, Annapolis Naval Academy and Fort Benning and are recruited as agents of the imperialist Central Intelligence Agency (CIA).

The AFP is supplied with weapons through the US Foreign Defense Financing Program, and arms procurements from other countries under the AFP Modernization Program are  supervised by US military advisers.

On the other hand, every counterrevolutionary campaign waged by the Philippine puppet government is patterned after US doctrine. The current Oplan Bayanihan is practically an exact copy of the US Counterinsurgency Guide of 2009.

The AFP was able to establish its politico-military power in all aspects of Philippine society during martial law's formal 14-year existence. The extent to which the Philippine social system has been militarized is boosted further as tens of thousands of former military officers occupy positions in the civilian bureaucracy. They are either appointed to various government agencies or elected to congress or local government posts. Militarizing the bureaucracy serves the purpose of accommodating retired ranking military officers who are cronies of reactionary politicians. In the same way, the AFP is able to use the civilian bureaucracy to advance its counterrevolutionary programs.

Using the military to deliver services that should be provided by civilian agencies of government has also become a widespread practice, and has become even more rampant under the US-Aquino regime's Oplan Bayanihan through the AFP's "peace and development organizing teams." Civil-military operations feature military troops conducting censuses and medical and dental missions, constructing and repairing schoolbuildings that are eventually used by them as barracks for as long as a year and even grotesque scenes of soldiers providing human rights education to schoolchildren.

This is an insidious effort to erase from the people's collective memory the evil role played by the reactionary military in sowing fascist terror and preserving the exploitative and oppressive ruling system. With the people's consciousness anesthesized into accepting the pervasiveness of the military and turning a blind eye to military abuses, their militant resistance to militarization wanes until they become tolerant of repression.

But all these efforts by the AFP, the Aquino regime and their US imperialist master are in vain. An institution that is puppet, repressive, corrupt and mercenary to the core can never be deodorized and will never evolve into a positive force in society.

With open fascist rule during the dark days of the Marcos dictatorship, the people became witness to militarization at its worst. Marcos' martial law has left a poisonous legacy of pervasive militarization and persistent military repression, perpetuated in the guise of "peace and development operations." This is the truth that must be brought to the fore with every commemoration of the martial law declaration.

There is no fitting response to relentless military repression other than for the people to tirelessly expose the truth and persevere in their resistance.

Government soldiers hit over raid, human rights violations in Basilan town

September 22, 2012 News: Civilians cried for justice over the raid and human rights violations committed by elements of Philippine Army Scout Rangers in a civilian community at Barangay Ulitan in Ungkaya Pukan, Basilan at early morning today.

“The government soldiers should respect human rights and protect us civilians. But unfortunately they harm us and violated our rights. We thought martial law is over but no in our homeland. We demand justice.”

Information received from the ground said more than 100 troops of Scout Rangers stormed Ulitan at passed 4am and immediately conducted raids on scores of civilian residences.
Four houses, at least, including the house of the community religious leaders, were reportedly raided.

Without saying anything, the government soldiers just destroyed the doors of the houses and told the residents inside to stay down on the floor.

“There were no search warrants shown and the government soldiers just search every corner and took with them some belongings,” the information stated.

Civilians from the vicinity run away in immense fear in the middle of the raid being conducted by soldiers in full combat gear.

“The early morning prayer was disrupted and civilians fled following this abusive military operation,” the information said.

Ulitan is a civilian village adjacent to the Municipal Government Hall of Ungkaya Pukan. The Scout Rangers came from their command post in Tipo-Tipo.

The affected civilians called on the local government unit of Ungkaya Pukan, Commission on Human Rights (CHR), human rights groups, the government and MILF ceasefire committees, and the civilian protection and human rights experts from the International Monitoring Team to probe the incident and for further appropriate actions o serve justice.

Government Peace Panel Chair Padilla Decries NPA Indemnification as Stopgap and Diversionary

Government Peace Panel Chair Padilla Decries NPA Indemnification as Stopgap and Diversionary

In a press statement of today, Alexander Padilla, Chair of the Government Panel in Peace Negotiations with the Communist Party of the Philippines-New People’s Army-National Democratic Front (CPP/NPA/NDF), decried the P5,000 payments to victims of the recent NPA grenade attack in Paquibato, Davao City as “stopgap and clouding the issue of violation of international humanitarian law and Philippine law”.  Targeting a military site, the September 1  NPA attack instead caused injury to 48 civilians.

Padilla said that the CPP-NPA’s refusal to turn over the perpetrators of the attack to the authorities and be subject to due process “adds insult to injury”. The NPA’s Merardo Arce Command belatedly owned up to the attack; and NPA spokesperson Rigoberto Sanchez said those responsible will be dealt with according to the CPP-NPA’s “revolutionary justice”.  But this “revolutionary justice”, Padilla noted, has been exposed as a “sham” by many including United Nations Special Rapporteur Philip Alston in a Report in 2008, without regard to the rule of law including basic rights (e.g. the right to counsel, to evidence).
Padilla pointed out that there have been countless civilian victims of collateral damage in over four decades of the Communist insurgency—“why has indemnification been raised only now?” For so long as “the CPP-NPA pursues armed struggle as the primary means to achieve its goals”, Padilla added, there will continue to be civilians caught in the crossfire. Will they “join the ranks of tens of thousands of unnamed and uncompensated civilian victims?” he asked.  Such issues as the use of landmines and child soldiers have been raised by the Government Peace Panel in on-and-off talks with its CPP-NPA-NDF counterparts.

“The demands of justice are predicated on a rule of law and cannot be met by one-off payments”, Padilla said. “The demands of peace must be negotiated peacefully at the table and not through gunfire and the torching of establishments”, he added. Padilla underscored President Aquino’s unilateral declaration of a ceasefire by government earlier today to mark the United Nations celebration of September 21 as International Day of Peace.

Hinggil sa paghahabol at panghihimasok ng China at sa Negosasyong Pangkapayapaan ng GPH-NDFP

Maikling komentaryo ni Prof. Jose Maria Sison, Pangulong Tagapagtatag, Partido Komunista ng Pilipinas at Punong Pampulitikang Konsultant, National Democratic Front of the Philippines

Pagsasalin sa Pilipino ng: On the China Claims and Intrusions and the GPH-NDFP Peace Negotiations

Prof. Jose Ma. Sison

CPP Founding Chairman

April 30, 2012

THE HUMAN ERROR IS NOT AN EXCUSE IN THE LIFE PUT INTO GRAVE OR SERIOUS AND LIGHTS INJURIES BUT A SERIOUS MISCONDUCT AND LESS KNOWLEDGE AND CAPABILITIIES AND TRAINING AND EDUCATIONS IN COMBAT BATTLE FIELD AND ACTIONS SPECIALLY IN EDUCATIONS OF HUMAN RIGHTS AND IHL TO HANDLE IN EVERY SITUATIONS… AS I READ IN CPP/NPA/NDF BY LAWS AND ORIENTATIONS AND PRINCIPLES AND STUDIES THE CPP/NPA/NDF IS NOT A TERRORIST TO TAKE LIFE OF INNOCENT PEOPLE IN CARRYING OUT THEIR PRINCIPLE IN THEIR PERSPECTIVE IN POLITICS AND WE WERE ACCORD IN YOUR LAWS PROMULGATIONS AND WE ARE PROMOTING TO YOUR ORGANIZATIONS TO RECTIFY YOUR ERROR IN RESPECTING AND FULLY UNDERSTAND THE HUMAN RIGHTS AND IHL……….

THE HUMAN RIGHTS AND IHL PROTOCOL IS ALWAYS IN THE CAPABILITIES AND ABILITIES TO HANDLE BY THE COMBAT FIGHTERS OR ACTION TAKERS IN RESOLVING SITUATIONS AND NOT JUST THE ABILITY TO THROW THE GRENADE OR SHOT THE RIFLE YOU HANDLE BUT YOU HAVE TO KNOW THE AIM AND TARGET AND SITUATIONS YOU ARE TAKING FOR…  THE BLAST, BLAST INNOCENT CIVILIANS AND I HOPE THEY ARE YOUR ENEMIES FOR MANY CASUALTIES BUT INNOCENT CASUALTIES ARE BLASTED TO DOWNFALL THE GOVERNMENT AND THEIR MORAL CAPABILITIES IN FIGHTING BUT YOUR MISTAKE IS THE BIG BOOMERANG FALLBACK INTO THE WHOLE ORGANIZATIONS ON THE ERROR OF  UNTRAINED AND UNEDUCATED COMBATANT FIGHTERS OF NEW PEOPLES ARMY…

THE HUMAN RIGHTS PROMOTIONS PROMOTES TO CPP/NPA/NDF TO GIVE REVOLUTIONARY JUSTICE ON THE CIVILIANS AND IMPLEMENT PUNISHMENTS OR DISCIPLINARY ACTIONS AGAINST ON THE COMBAT FIGHTERS OF NPA WHO ARE COMMIT THE MISTAKES AND AS THE IHL AND CARHRIHL AGREEMENT AND YOUR PLEDGED IN THE NDF STATEMENTS TAKE CARE OF THOSE CIVILIANS INDEMNIFY FOR THEIR INJURIES AND GIVE MORAL ASPECT EDUCATIONS TO THEM TO LIVE IN A GOOD LIFE WITHOUT FEAR IN INTERNAL CONFLICT THAT ERROR WILL PREVAIL AGAIN IN THE NEXT FUTURE IN COMBAT OFFENSIVES WHICH THERE IS HUMAN RIGHTS AND IHL PROTOCOL TO HANDLE BY EACH FIGHTERS ABILITIES IN COMBAT AND ACTIONS TO PREVENT THIS MISCONDUCTS IN COMBAT…

WE WOULD LIKE TO PROMOTE IN CPP/NPA/NDF TO GIVE SERIOUS PUNISHMENT AGAINST THOSE FIGHTERS COMMITTING MISTAKES AS LEARN TO ALL NPA RED FIGHTER FOR BE HUMAN RIGHTS AND IHL CAPABLE HANDLERS IN FIGHTING FOR NOT COMMITTING MISTAKES IN ANY OPERATIONS AND ACTIONS…. WE ARE DEALING INNOCENT LIFE HERE IN MISCONDUCT AND ERRORS THAT HAS NO ROOM FOR INACCURACY IN ACTIONS OF THE FIGHTERS…IT IS A PAINFUL SITUATIONS TO FACE IN THE PART OF YOUR COMRADES BUT WE HAVE TO FACE THE REALITY OF YOUR MISTAKES AND THERE IS EQUAL PUNISHMENT IN THAT MISTAKES… WE ARE IN GREAT THANKS TO CPP/NPA/NDF FOR YOUR SELF CRITICISM ON YOUR MISTAKES AND REAFFIRMING IT AND PLEDGED YOUR RESOLUTIONS FOR THE INCIDENT AND FOR THE VICTIMS BENEFITS AND BENEFITS OF THE PEOPLE….   DO THE NECESSARY UPLIFTING THEIR MORAL MINDS IN THE INCIDENTS FOR THERE IS HUMAN RIGHTS AND IHL WILL PROTECT THEM IN GENERAL AND YOUR MOVEMENTS ARE ACKNOWLEDGING AND ABIDING HUMAN RIGHTS AND IHL FOR THE PROTECTION OF THE INNOCENT PEOPLE EVEN AGAINST THE CONDUCT OF THE CPP/NPA/NDF MISTAKES….

THE HUMAN RIGHTS AND IHL IS THE “TABI TABI PO” PROTOCOLS AND RULES ALSO FOR THE BENEFITS OF EVERYONE SPECIALLY CIVILIANS IN INTERNAL ARMED CONFLICT FOR THEY ARE NOT BECOME THE TARGET AND BEING CROSS FIRED IN THE COMBAT BATTLE WHICH IS ALWAYS THE SCENARIO IN THE BATTLE AND VIOLATIONS EXPERIENCE  IN THE BATTLE AND ACTIONS IN ANY SIDE FROM CPP/NPA/NDF OR THE GOVERNMENT.  THE PEOPLE ARE SUFFERS IN THE CONFLICT, ABIDE THE PROTOCOLS AND ALWAYS PUT IT IN THE MIND OF EVERY FIGHTERS IN AIMING THEIR GUN ON THEIR OPPONNENT'S..……

THE GOVERNMENT ARMED FORCES AND THE NPA IS NOT ONLY THE PEOPLE IN THE PHILIPPINES, THERE IS CIVILIANS INNOCENT WHO YOU ARE FIGHTING FOR AND PROTECTING FOR.  THERE IS TABI TABI PROTOCOLS TO ABIDE OR MAY MGA TAONG INOSENTE AT BUHAY AT KARAPATAN NA DAPAT ISAALANG-ALANG ANG BAWAT MGA MANDIRIGMA NG MAGKABILANG PANIG…… SIMPLY DO NOT JUST WALK IN THE AISLE OF A MARKET WHICH YOU WILL SCATTERS A BUNCH OF TOMATOES…. ARE YOU IN YOUR MIND FOR EXAMPLE WILL ENGAGE GUN BATTLE IN THE AREA WHICH IS FULL OF INNOCENT CIVILIANS AND HOW IS YOUR CAPABILITIES TO HANDLE THE SITUATIONS, EVEN YOU ARE A SHARP SHOOTER ENGAGE IN THE FULL OF CIVILIANS, GUN BATTLE IS UN PERMITTED, THE “TABI TABI PO” PROTOCOL HAS TO HANDLE ON THINKING INNOCENT PEOPLES RIGHTS AND THEIR RIGHT TO PEACE ETC ETC AS WHAT HAPPENED IN PAQUIBATO THE AREA IS FULL OF CIVILIANS FOR THE GRENADE ENGAGEMENT WILL INJURED CIVILIANS AND NOT JUST THE ENEMY TARGET AND YOUR CAPABILITIES AND TRAINING AND HUMAN RIGHTS AND IHL EDUCATIONS MUST  BE EXECUTED IN THIS ACTIONS….

THIS IS THE QUESTION HOW THE BARACKS OF THE MILITARY ARE IN THE SOURROUNDINGS OF CIVILIANS FOR IT IS PROHIBITED ON THE PERIMETER OF THE GOVERNMENT FORCES ?  THE GOVERNMENT HAS TO TAKE ERRORS ALSO IN THIS SCENARIO FOR PUTTING BARRACKS OR AFP CAMP SOURROUNDED BY THE INNOCENT CIVILIANS THEY ARE DOING THIS KIND OF POSITIONS STRATEGY WHICH THE IHL UNPERMITTED THE TACTICAL OFFENSIVES IN THE CIVILIANS AREA AND IF THEY PUT THEIR BARACKS SORRUOND BY THE CIVILIANS THE ENEMY WILL NOT ENGAGED WITH THEM, HOW IF IN THIS SCENARIO THE ENEMY MAKE MISTAKES ON MAKING TACTICAL OFFENSIVE AGAINST YOUR POSITIONS, THERE ARE MANY CIVILIANS INJURED CASUALTIES WHO ARE VIOLATED THEIR RIGHTS…ON ARTICLE 12 OF CARHRIHL THE MILITARY CAMPS ARE PROHIBITED IN POPULATED AREAS...

THE INSTALLATIONS OF THE GOVERNMENT FORCES, CAMP, SATELLITE CAMP BARRACKS ETC. ETC. IN PARTICULAR  ARE ENTITLED FOR OFFENSIVES BY ENEMY IN THE PROTOCOL OF IHL AS NOT STIPULATED AREA FOR MILITARY OFFENSIVES, IT IS THE STATIONARY TARGET PERMITTED BY THE IHL IN THE SOCIAL STRUCTURE. PROMOTIONS TO GOVERNMENT AFP FORCES ESTABLISHED YOUR CAMP AND  BARRACKS IN THE PERIMETER WHO ARE NOT IN CIVILIANS AREA…..I HOPE YOU KNOW THAT THE ENEMY WILL ENGAGE IN YOUR LINE TO PULL YOU DOWN YOUR POSITIONS SO IN THIS CONNECTION PUT YOUR BARRACKS IN THE AREA WHICH IS THERE IS NO CIVILIANS IN THE AREA OR BE ISOLATED IN CIVILIANS AREA SO THEY ARE NOT BEING CROSS-FIRED OR TARGETED INDIRECTLY IN THE OFFENSIVES……

I HOPE THE AFP KNOW THE PRIME TARGET OF THE REBELS TO PULLDOWN THE GOVERNMENT IS THE FORCES OF THE GOVERNMENT AND THE HUMAN RIGHTS AND IHL PROTOCOL ALSO IS MUST IMPLEMENTATIONS IN LEGAL WHICH UNDER THE PROTOCOL OF IHL ONLY COMBATANT ARE ENTITLE IN COMBAT BATTLE WHICH IS THE AFP IN THE GOVERNMENT PRACTICE IN OUR LAND AS COMBATANT AND POLICE FORCE OR ANY GOVERNMENT USE FORCES.  “DO NOT USE THE ALIBI OF PROTECTING PEOPLE IN PUTTING BARRACKS WITH THE PERIMETERS OF CIVILIANS AREA, YOU ARE JUST MAKING THE INNOCENT PEOPLE AS COVER FROM THE INSURGENTS”…

THE HUMAN RIGHTS ADVOCACY PROMOTIONS ARE PROMOTING HUMAN RIGHTS AND IHL AND CARHRIHL AND PEACE TALKS IN THE INTERNAL ARMED CONFLICT INSURGENCY IN THE PHILIPPINES.  ABIDE STRICTLY THE PROTOCOLS AND HUMAN RIGHTS FOR THE HUMANE AND CIVILIZED SOCIETY EVEN UNDER THE MIDST OF INSURGENCY…

DO NOT FORGET THE “TABI TABI PO PROTOCOL FOR THE BENEFITS OF INNOCENT PEOPLE” O PAGSASAALANG-ALANG ALANG NG BUHAY AT KARAPATAN NG TAO OR THE HUMAN RIGHTS LAW AND IHL PROTOCOLS IN THE INTERNAL CONFLICTS FOR THE INNOCENT CIVILIANS IN THE CLASHES OF THE OPPOSITE FIGHTERS….

TO ALL THE VICTIMS AND ALSO TO FILIPINO PEOPLE ON THE VIOLATIONS OF HUMAN RIGHTS AND IHL AND CARHRIHL BY THE CPP/NPA/NDF DO NOT BE AFRAID IN THE FUTURE ON WHAT HAPPENED THERE IS HUMAN RIGHTS AND IHL STILL TO IMPLEMENT FOR THE BENEFITS OF EVERY INNOCENT PEOPLE…  THE GUILTY PARTY ARE POLITELY IN THE PROCESS OF IMPLEMENTING THE RESOLUTIONS FOR THEIR VIOLATIONS IN THE RESPECT AND ABIDANCE OF HUMAN RIGHTS AND IHL AND CARHRIHL… THE PAIN IS STILL IN YOUR HEART AND THE FORGIVENESS ARE AWAITING TO GIVE IN THE SITUATIONS FROM THE VICTIMS AND ANY CONCERNS, FACE THE FUTURE AND CONTINUE YOUR LIFE AND DISCOVER THE MEANING OF INSURGENCY IN THE PHILIPPINES……

PROTECT AND PROMOTE AND HUMAN RIGHTS….

A Self-Criticism on The Paquibato Incident

Rigoberto F. Sanchez

Merardo Arce Command, Southern Mindanao Regional Operations Command, New People's Army
September 6, 2012

The Merardo Arce Command-Southern Mindanao Regional Operations Command of the New People’s Army (MAC- SMROC-NPA) takes full responsibility for the grenade throwing to an AFP detachment in Brgy. Fatima, Paquibato District, Davao City, September 1 at 8:30 PM. The NPA issues this self-criticism to apologize to the public and the families for the scores of casualties, including children. The NPA will take concrete measures to indemnify the victims consistent with the principles of revolutionary justice and the policies governing the New People’s Army and the revolutionary movement.

The NPA’s 1st Pulang Bagani Company made a wrong decision in initiating a tactical offensive against the AFP detachment located in a civilian population. The NPA’s 1st PBC aimed in trageting a legitimate target to emasculate the enemy and wipe out its structure that has placed the lives and properties of the people in danger. But it erred in considering the circumstances, combat intelligence and all pertinent operational information in instigating the NPA action. In the face of this gross mistake in judgement, the MAC-SMROC-NPA is currently initiating an internal investigation and is ready to take appropriate courses of action, to include among others, disciplinary action on the responsible unit.

The NPA stands firm for justice and truth and is prepared to rectify mistakes. By issuing this unflinching public apology and self-criticism, the NPA abides with the principled standpoint, viewpoint and method adopted by the NPA and the revolutionary movement.

NDF-SMR Order of Indemnification to Paquibato blast Casualties

Rubi del Mundo
National Democratic Front of the Philippines, Southern Mindanao
12 September 2012

The Regional Council of the National Democratic Front of the Philippines-Southern Mindanao Region orders for the indemnification of the wounded individuals, including children, who were casualties of the September 1, 2012 grenade blast in Barangay Fatima, Paquibato, Davao City.

The order acts upon the recommendations submitted by the Merardo Arce Command-Southern Mindanao Regional Operations Command- New People's Army.

The directive is a unilateral exercise of revolutionary political authority by a government of the working class and peasantry that has its own legal and judicial system and rules in accordance with its political principles and circumstances.

The NDF-SMR Order of Indemnification is in compliance with the following with an attached annex:
a. NDFP Declaration of Undertaking to Apply Geneva Conventions of 1949 and Protocol I of 1977 which asserts its status as co- belligerent under international law and assumes its rights and responsibilities under the Geneva Conventions and its protocols. Notwithstanding the Declaration, the revolutionary forces and people represented by the NDFP have acquired over the years the status of belligerency through revolutionary armed struggle. The declaration itself commits the revolutionary forces to the observance of laws of war, from the level of adherence to Protocol II in 1991 to the Geneva Conventions and Protocol I.

b. Geneva Conventions of 1949 and Protocol I of 1977 as the basic international instrument on the rules of armed conflicts seek to ameliorate the conditions of the wounded and sick armed forces, the humane treatment of prisoners of war and the protection of civilian persons in time of war. Protocol I further expands these rules on protection of civilian persons and populations in international armed conflicts.

c. Comprehensive Agreement on Respect for Human Rights and International Humanitarian Law (CARHRIHL) which provides for the indemnification and compensation to parties affected in the armed conflict. Under the CARHRIHL, the GPH itself recognized  the separate authority of the NDFP to take actions pertaining to address issues concerning human rights and international humanitarian law.

d. Constitutional Guide for Establishing the People's Democratic Government that sets forth the fundamental rights of the people.

e. Basic Rules of the New People's Army which require respect for human rights and humanitarian law by its officers, combatants and members.

To expedite  the dispensation of indemnification and to make public this exercise of executive function, the NDF-SMR has asked for the intercession of concerned professionals and peace advocates who will compromise the Third Party Facilitators.
