The Merardo Arce Command-Southern Mindanao Regional Operations Command of the New People’s Army (MAC- SMROC-NPA) takes full responsibility for the grenade throwing to an AFP detachment in Brgy. Fatima, Paquibato District, Davao City, September 1 at 8:30 PM. The NPA issues this self-criticism to apologize to the public and the families for the scores of casualties, including children. The NPA will take concrete measures to indemnify the victims consistent with the principles of revolutionary justice and the policies governing the New People’s Army and the revolutionary movement.

The NPA’s 1st Pulang Bagani Company made a wrong decision in initiating a tactical offensive against the AFP detachment located in a civilian population. The NPA’s 1st PBC aimed in trageting a legitimate target to emasculate the enemy and wipe out its structure that has placed the lives and properties of the people in danger. But it erred in considering the circumstances, combat intelligence and all pertinent operational information in instigating the NPA action. In the face of this gross mistake in judgement, the MAC-SMROC-NPA is currently initiating an internal investigation and is ready to take appropriate courses of action, to include among others, disciplinary action on the responsible unit.

The NPA stands firm for justice and truth and is prepared to rectify mistakes. By issuing this unflinching public apology and self-criticism, the NPA abides with the principled standpoint,viewpoint and method adopted by the NPA and the revolutionary movement.

NDF-SMR Order of Indemnification to Paquibato blast Casualties

The Regional Council of the National Democratic Front of the Philippines-Southern Mindanao Region orders for the indemnification of the wounded individuals, including children, who were casualties of the September 1, 2012 grenade blast in Barangay Fatima, Paquibato, Davao City.

The order acts upon the recommendations submitted by the Merardo Arce Command-Southern Mindanao Regional Operations Command- New People's Army.

The directive is a unilateral exercise of revolutionary political authority by a government of the working class and peasantry that has its own legal and judicial system and rules in accordance with its political principles and circumstances.

The NDF-SMR Order of Indemnification is in compliance with the following with an attached annex:
a. NDFP Declaration of Undertaking to Apply Geneva Conventions of 1949 and Protocol I of 1977 which asserts its status as co- belligerent under international law and assumes its rights and responsibilities under the Geneva Conventions and its protocols. Notwithstanding the Declaration, the revolutionary forces and people represented by the NDFP have acquired over the years the status of belligerency through revolutionary armed struggle. The declaration itself commits the revolutionary forces to the observance of laws of war, from the level of adherence to Protocol II in 1991 to the Geneva Conventions and Protocol I.

b. Geneva Conventions of 1949 and Protocol I of 1977 as the basic international instrument on the rules of armed conflicts seek to ameliorate the conditions of the wounded and sick armed forces, the humane treatment of prisoners of war and the protection of civilian persons in time of war. Protocol I further expands these rules on protection of civilian persons and populations in international armed conflicts.

c. Comprehensive Agreement on Respect for Human Rights and International Humanitarian Law (CARHRIHL) which provides for the indemnification and compensation to parties affected in the armed conflict. Under the CARHRIHL, the GPH itself recognized  the separate authority of the NDFP to take actions pertaining to address issues concerning human rights and international humanitarian law.

d. Constitutional Guide for Establishing the People's Democratic Government that sets forth the fundamental rights of the people.

e. Basic Rules of the New People's Army which require respect for human rights and humanitarian law by its officers, combatants and members.

To expedite  the dispensation of indemnification and to make public this exercise of executive function, the NDF-SMR has asked for the intercession of concerned professionals and peace advocates who will compromise the Third Party Facilitators.
 

The Third Party Facilitators will award the compensation, but is not limited to, the following affected individuals:

CIDG files criminal cases against Kato, BIFF members


The Criminal Investigation and Detection Group (CIDG) has filed criminal cases against commander Ustadz Ameril Umbra Kato and other members of the Bangsamoro Islamic Freedom Fighters (BIFF).

Police Director Samuel D. Pagdilao, Jr., CIDG chief, said the case filed against Kato and BIFF members at the Maguindanao Provincial Prosecutor's Office with NPS Docket# XIV-05-INV-121-00190 will allow the CIDG to pursue them with the full force of the law behind it.

"We filed cases of multiple murder, multiple frustrated murder, multiple attempted murder, kidnapping, and robbery with homicide against Kato and his followers in connection with the atrocities they committed in Mindanao," he said.

The cases filed against Kato and his followers were borne out of an investigation conducted by the CIDG on a series of a attacks perpetrated by the BIFF against government troops and civilians in Maguindanao.

The group had stormed an Army and paramilitary installations in Maguindanao's five adjoining towns last August 5.

Besides Kato, the CIDG filed cases against BIFF officers Muhammad Ali Tambako, Badrudin Silongan, Kagi Karialan, Abu Missry and 109 other members of the group.

Several John Does connected to the group were also included in the CIDG's case build up against the BIFF.

BIAF Western Front disseminates Deed of Commitment under Geneva Call


September 13, 2012 News: The Western Mindanao Front of the Bangsamoro Islamic Armed Forces  (WMF – BIAF) started its information and education campaign (IEC) on the Moro Islamic Liberation Front Deed of Commitment under Geneva Call.
A staff of the Front Commander of the WMF – BIAF relayed this, saying “the BIAF General Staff gave the Front Command the go signal to incorporate in its continuing advocacy programs on the progress and prospects of the GPH – MILF peace process the dissemination of the MILF Deed of Commitment.”
“We have a new Front Commander for WMF from Basilan and very busy with his peace advocacy programs in the area of responsibility covering the island provinces of Basilan, Sulu, Tawi-Tawi and Zamboanga Peninsula,” he said.
Few days ago, hundreds of MILF members from civil-political committees and BIAF units attended the WMF – BIAF peace advocacy in Lamitan, he pointed out.

The next peace advocacy will be at MILF Camp Salman Al Farishi in Tungawan, Zamboanga Sibugay. MILF CCCH will coordinate this undertaking with its counterpart with GPH CCCH.
“The entire Front Command is fully supportive of the peace process and we are very glad of the result of the last peace talks between the government and MILF in Malaysia last week,” he said.

“Our team who attended the Training of Trainers (TOT) for the Deed of Commitment under the Geneva Call for total ban on anti-personnel mines and for cooperation in mine action are tasked for the dissemination drives to the forces on the ground,” he added.
The TOT conducted by Geneva Call, BIAF General Staff and Institute of Bangsamoro Studies (IBS) at the Training Center of the Bangsamoro Leadership and Management Institute (BLMI) last July 7, 2012 was participated by some 40 representatives from the General Staff, Front Commands and Base Commands of the Bangsamoro Islamic Armed Forces (BIAF) - MILF participate in the ongoing training. 

Under the Deed of Commitment, the MILF is enjoined to 1. Issuances of written Orders and Directives to the BIAF from the General Staff for strict compliance to the Deed of Commitment; 2.  Effective information dissemination to the BIAF rank and file; 3. Changes in BIAF military doctrines to remove the use of anti - personnel mines (APMs);  4. Conduct of various trainings starting with technical briefings and seminar-workshops for BIAF General Staff and field commanders, mine and humanitarian education programs which reach the foot soldiers; and 5. BIAF military disciplinary actions for violations or non-compliance.

KUALA LUMPUR, September 5 Government chief peace negotiator Marvic Leonen today urged his counterparts in the Moro Islamic Liberation Front (MILF) that they resolve the “remaining contentious points” in their ongoing peace talks in Malaysia and so they can finally bring home a viable “framework agreement” for a peaceful Mindanao.

Speaking at the opening of the 31st round of Formal Exploratory Talks in Kuala Lumpur, Malaysia Wednesday, Leonen underscored the optimism of the government that the remaining issues in the peace process will finally be resolved.

“In this round of talks, the government proposes to discuss the remaining contentious points that will go into our framework agreement,” Leonen said. “Although at first we may seem to take different positions on these issues, we know that both our negotiating panels have the capability and the willingness to be able to sufficiently exhaust our reasons in dialogue.”

“We thus propose that in this round, we take as our objective that we take home to our principals a completed product, a consensus draft, even a very rough draft with some options of a framework agreement for their serious consideration,” Leonen explained.

“We have set for ourselves a timetable that we hope to be able to achieve. We think this timetable will allow all of us to be able to take advantage of the propitious political environment that we are in, to definitively deliver our mutual political commitments to each other,” he added.

The four-day peace negotiations between the Philippine government and the MILF resumed today in this Malaysian capital amidst optimism expressed by both parties in recent weeks to be able to come up with a peace agreement soon.

“We seek that all guns be silenced permanently. And by all guns, we mean all guns. That it is these guns that will become a memory and that our disagreements, our disappointments and perhaps even our anger will never be again channeled to cause deaths in violent confrontation,” Leonen said. “We seek that our differences be settled in peaceful and deliberative fashion with the government at any level, which follows laws that have earned the respect of its constituents.”

Leonen cited the need to “make haste so that we can usher in the agreement that will set up the platforms so that we can not only build more trust and confidence amongst our constituents but catalyze the kind of societies that our peoples deserve.”
In his own opening statement, MILF chief negotiator  Mohagher Iqbal echoed the positive note expressed by Leonen on the outcome of the peace talks.

“Today, the GPH-MILF peace negotiations are passing through a defining moment, a critical phase, which allows no complacency on the part of the parties,” Iqbal said.

For his part, Malaysian facilitator Tengku Dato Abd Ghafar Tengku Mohammed commended both sides for being “very serious in trying to solve the Mindanao problem.”

In his statement, Iqbal reiterated the commitment of the MILF to the prevailing ceasefire between the government and MILF forces. He stressed that the MILF had taken decisive action against groups that he described as “spoilers” to the peace process.

“Very clearly, these spoilers are mounting up their guns and gunning up on us and certainly if they had their way they wanted us to stop and fail. This aggression of the so-called BIFM-BIFF is a clear example,” Iqbal said.

“Their agenda as I mentioned previously was two-fold: to shame the government and the MILF and to stop the peace talks. What made their sinister acts doubly serious is that they are not acting alone,” he explained.

“The collisions of some personalities or groups are documented, but which I do not want to divulge details in this speech lest it will stir another complication.”

Iqbal said he was confident that the Philippine government and the military “given their good intelligence network, is fully aware of this development.” #
