The persistence of military rule in the country

Military terrorism persists in the country. Military rule remains a reality 40 years after Ferdinand Marcos' formal declaration of martial law on September 21, 1972 and 26 years after his regime was overthrown in a people's uprising in February 1986.

Marcos used martial law to perpetuate himself in power and strengthen the rule of foreign big capitalists, big bourgeois compradors, landlords and bureaucrat capitalists.


Despite the much-vaunted restoration of democracy, there is little to distinguish succeeding regimes from the despised Marcos fascist dictatorship. Even without a formal martial law declaration, state terrorism is able to prevail. The exploiters and oppressors backed up by martial law continue to lord it over.

This has been made possible through the intensified militarization of the country since the time of Corazon Aquino's regime up to that of her son Benigno Aquino III. The current regime bears the notoriety of launching massive and incessant military operations and maintaining a heavy military presence in peasant and urban poor communities nationwide.

To preserve the rotten and bankrupt semicolonial and semifeudal system, the Armed Forces of the Philippines (AFP), the Philippine National Police (PNP) and other armed minions of the reactionary state have been expanded and given major roles to play since 1972. The AFP's ascendance in many aspects of Philippine society is a manifestation of the continuously worsening crisis of the ruling system, which has made it necessary to strengthen the coercive forces of the state and suppress the people's growing resistance.

Marcos beefed up the AFP from 60,000 to 100,000 troops upon the declaration of martial law and further expanded it to 250,000 in mid-1975 after integrating the forces of the PC-INP. After martial law, the AFP's size further swelled to 200,000 and the PNP from 115,000 to its current size of 140,000. These figures do not include paramilitary forces like the CAFGU and other armed groups controlled by the military whose numbers have also grown severalfold.

The AFP not only serves as the strongest bastion of the reactionary ruling system. It is also US imperialism's most reliable instrument for ensuring its dominance over the country. The AFP is the US' most unflinching ally in the protection of its strategic interests in the Philippines and in stabilizing the reactionary political system, safeguarding foreign investments and suppressing the anti-imperialist and revolutionary forces. Towards this end, US imperialism has taken tremendous efforts to strengthen the AFP's organization, supply it with weapons and train its personnel on current US doctrine.

The AFP and PNP, in fact, trace their origins to the first mercenary troops from Macabebe, Pampanga who were used by the American colonialists to pursue Filipino revolutionaries resisting US occupation troops from 1899-1903. These forces later evolved into the Philippine Scouts (which later became the Philippine Scout Rangers) and the Philippine Constabulary.

Key officers of the AFP are sent for training to US military institutions such as West Point Military Academy, Annapolis Naval Academy and Fort Benning and are recruited as agents of the imperialist Central Intelligence Agency (CIA).

The AFP is supplied with weapons through the US Foreign Defense Financing Program, and arms procurements from other countries under the AFP Modernization Program are  supervised by US military advisers.

On the other hand, every counterrevolutionary campaign waged by the Philippine puppet government is patterned after US doctrine. The current Oplan Bayanihan is practically an exact copy of the US Counterinsurgency Guide of 2009.

The AFP was able to establish its politico-military power in all aspects of Philippine society during martial law's formal 14-year existence. The extent to which the Philippine social system has been militarized is boosted further as tens of thousands of former military officers occupy positions in the civilian bureaucracy. They are either appointed to various government agencies or elected to congress or local government posts. Militarizing the bureaucracy serves the purpose of accommodating retired ranking military officers who are cronies of reactionary politicians. In the same way, the AFP is able to use the civilian bureaucracy to advance its counterrevolutionary programs.

Using the military to deliver services that should be provided by civilian agencies of government has also become a widespread practice, and has become even more rampant under the US-Aquino regime's Oplan Bayanihan through the AFP's "peace and development organizing teams." Civil-military operations feature military troops conducting censuses and medical and dental missions, constructing and repairing schoolbuildings that are eventually used by them as barracks for as long as a year and even grotesque scenes of soldiers providing human rights education to schoolchildren.

This is an insidious effort to erase from the people's collective memory the evil role played by the reactionary military in sowing fascist terror and preserving the exploitative and oppressive ruling system. With the people's consciousness anesthesized into accepting the pervasiveness of the military and turning a blind eye to military abuses, their militant resistance to militarization wanes until they become tolerant of repression.

But all these efforts by the AFP, the Aquino regime and their US imperialist master are in vain. An institution that is puppet, repressive, corrupt and mercenary to the core can never be deodorized and will never evolve into a positive force in society.

With open fascist rule during the dark days of the Marcos dictatorship, the people became witness to militarization at its worst. Marcos' martial law has left a poisonous legacy of pervasive militarization and persistent military repression, perpetuated in the guise of "peace and development operations." This is the truth that must be brought to the fore with every commemoration of the martial law declaration.

There is no fitting response to relentless military repression other than for the people to tirelessly expose the truth and persevere in their resistance.

Government soldiers hit over raid, human rights violations in Basilan town



September 22, 2012 News: Civilians cried for justice over the raid and human rights violations committed by elements of Philippine Army Scout Rangers in a civilian community at Barangay Ulitan in Ungkaya Pukan, Basilan at early morning today.

“The government soldiers should respect human rights and protect us civilians. But unfortunately they harm us and violated our rights. We thought martial law is over but no in our homeland. We demand justice.”

Information received from the ground said more than 100 troops of Scout Rangers stormed Ulitan at passed 4am and immediately conducted raids on scores of civilian residences.
Four houses, at least, including the house of the community religious leaders, were reportedly raided.

Without saying anything, the government soldiers just destroyed the doors of the houses and told the residents inside to stay down on the floor.

“There were no search warrants shown and the government soldiers just search every corner and took with them some belongings,” the information stated.

Civilians from the vicinity run away in immense fear in the middle of the raid being conducted by soldiers in full combat gear.

“The early morning prayer was disrupted and civilians fled following this abusive military operation,” the information said.

Ulitan is a civilian village adjacent to the Municipal Government Hall of Ungkaya Pukan. The Scout Rangers came from their command post in Tipo-Tipo.

The affected civilians called on the local government unit of Ungkaya Pukan, Commission on Human Rights (CHR), human rights groups, the government and MILF ceasefire committees, and the civilian protection and human rights experts from the International Monitoring Team to probe the incident and for further appropriate actions o serve justice.

In a press statement of today, Alexander Padilla, Chair of the Government Panel in Peace Negotiations with the Communist Party of the Philippines-New People’s Army-National Democratic Front (CPP/NPA/NDF), decried the P5,000 payments to victims of the recent NPA grenade attack in Paquibato, Davao City as “stopgap and clouding the issue of violation of international humanitarian law and Philippine law”.  Targeting a military site, the September 1  NPA attack instead caused injury to 48 civilians.

Padilla said that the CPP-NPA’s refusal to turn over the perpetrators of the attack to the authorities and be subject to due process “adds insult to injury”. The NPA’s Merardo Arce Command belatedly owned up to the attack; and NPA spokesperson Rigoberto Sanchez said those responsible will be dealt with according to the CPP-NPA’s “revolutionary justice”.  But this “revolutionary justice”, Padilla noted, has been exposed as a “sham” by many including United Nations Special Rapporteur Philip Alston in a Report in 2008, without regard to the rule of law including basic rights (e.g. the right to counsel, to evidence).
Padilla pointed out that there have been countless civilian victims of collateral damage in over four decades of the Communist insurgency—“why has indemnification been raised only now?” For so long as “the CPP-NPA pursues armed struggle as the primary means to achieve its goals”, Padilla added, there will continue to be civilians caught in the crossfire. Will they “join the ranks of tens of thousands of unnamed and uncompensated civilian victims?” he asked.  Such issues as the use of landmines and child soldiers have been raised by the Government Peace Panel in on-and-off talks with its CPP-NPA-NDF counterparts.

“The demands of justice are predicated on a rule of law and cannot be met by one-off payments”, Padilla said. “The demands of peace must be negotiated peacefully at the table and not through gunfire and the torching of establishments”, he added. Padilla underscored President Aquino’s unilateral declaration of a ceasefire by government earlier today to mark the United Nations celebration of September 21 as International Day of Peace.

Nagpapasalamat ako sa aking mahal na kaibigan, si General Joone de Leon, sa pagbibigay ng lektura hinggil sa aking sosyo-pulitikal na pilosopiya, at sa kanya, at sa inyong lahat na nasa Regular Class 47 ng Masters program hinggil sa National Security Administration sa pagbibigay ng pribilehiyo at karangalang maipahayag ko ang aking pusisyon at rekomendasyon hinggil sa ilang maiinit na usaping may malaking kabuluhan sa ating bansa at mamamayan.



Kaugnay sa paghahabol at panghihimasok ng China sa Kalayaan group of islands at sa Panatag shoal, itinuturing kong usapin ng prinsipyo at patriyotikong katungkulan na itaguyod ang pambansang soberanya ng sambayanang Pilipino at ang teritoryal na integridad ng Pilipinas. Ang nabanggit na mga teritoryo ay saklaw ng 200-milyang notikal ng eksklusibong sonang ekonomiko ng Pilipinas sa ilalim ng UN Convention on the Law of the Sea (UNCLOS) na nilagdaan at dapat ipatupad kapwa ng Pilipinas at China.


Iginagawad sa atin ng UNCLOS ang pinakamatibay na batayan sa ilalim ng internasyunal na batas para igiit ang ating karapatan sa naturang mga isla, buhanginan at bahurang pinagtatalunan. Pinatutunayan ng mga ebidensyang arkeolohikal na ginamit ito ng mga naunang tao sa Pilipinas sa pangingisda, pangunguha ng korales at paglalayag mula pa noong panahong pre-istoriko. Pinatutunayan din ng kolonyal na pagmamapa ng mga Espanyol at mga tala sa kasaysayan na sakop ang mga teritoryong ito ng kapuluan ng Pilipinas. Kasama sa Morillo Map na ginamit ng US at Spain sa pagbubuo ng Treaty of Paris ang Bajo de Masinloc at Scarborough Shoal o Panatag Shoal.


Sa kabila ng paggigiit nito, iniiwasan pa rin ng China ang anumang tahasang agresyong militar. Mulat ito marahil sa palagian nitong sinasabi na naging makapangyarihan ito sa payapang paraan at sa komitment nito sa UNCLOS at sa Declaration on Conduct of Parties in the South China Sea. Sa pakikipagdebate ko sa mga banyagang rebolusyonaryo na nagsasabing isa nang imperyalistang kapangyarihan ang China, pinaninindigan ko na totoong naging kapitalista na ang China at nag-eeksport na ng signipikanteng halaga ng labis na kapital, subalit di pa ito nagtatalaga ng mga tropang pangkombat upang itaguyod at protektahan ang dayuhang pamumuhunan nito. Kahit sa peacekeeping operations ng UN, na nilalahukan ng China, iniiwasan nitong magtalaga ng mga tropang pangkombat.


Kailangan din nating ituring na usapin ng prinsipyo at tungkulin ang paghahanap ng mapayapang resolusyon sa mga usaping teritoryal sa China ayon sa itinatakda ng UNCLOS at ng Declaration on Conduct of Parties in the South China Sea. Hangga't posible, maaari tayong makipagnegosasyon sa China, o maaari ring idaan ang usapan sa ASEAN. Mulat tayo sa limitasyon ng ganitong mga pamamaraan at kung paano ito maaaring tumagal nang tumagal. Kaya dapat lagi nating igiit na tapusin ang usapin sa pinakamaagang panahon sa pamamagitan ng paghahapag ng kaso ayon sa UNCLOS sa International Tribune on the Law of the Sea sa Hamburg.


Para na rin sa interes ng ating bansa ang di pagsangkot sa Pilipinas at mamamayang Pilipino sa anumang aksyong makapipinsala sa atin, tulad ng di kinakailangang gera o kahit ng di kinakailangang pagpapamalas ng pwersang militar o probokasyon. Ipinakikita ng China ang kiling nito sa aksyong ekonomiko at diplomatiko kaysa sa aksyong militar sa pagresolba ng mga internasyunal na usapin. Di tayo dapat magpadala sa ilusyon na nariyan ang US para tayo'y ipagtanggol. Dapat nating tandaan na may mas malaking interes ang US sa China kaysa sa Pilipinas at ang US-RP Mutual Defense Treaty, na walang probisyon para sa awtomatikong pagganti, ay nagpapahintulot sa US na iwasang pumanig sa Pilipinas laban sa China. Desidido ang US na kontrolin at manipulahin ang mga kontradiksyon sa pagitan ng Pilipinas at China upang ibayong lumakas ang presensyang militar nito sa Pilipinas, patuloy na labagin ang ating pambansang soberanya at teritoryal na integridad, maging bantay-salakay at paigtingin ang pagsisikap nitong palakasin ang hegemonya ng US sa Asia-Pacific.


Kaugnay sa negosasyong pangkapayapaan ng GPH-NDFP, paralisado ito dahil sa katigasan ng pusisyon ng gubyernong Aquino o sa partikular, ng Presidential Adviser on the Peace Process (PAPP) hinggil sa kagyat na pagpapasuko at pagsupil sa mga rebolusyonaryong pwersang kinakatawan ng NDFP; pagbalewala sa The Hague Joint Declaration ng 1992 sa pamamagitan ng pagbansag dito bilang dokumento ng anito'y walang hanggang pagkakahati kaysa posibleng balangkas sa negosasyong pangkapayapaan; pagtabing, pagkunsinti at pagpapanatili sa ekstrahudisyal na pamamaslang, tortyur at detensyon ng mga konsultant at istap ng NDFP na labag sa Joint Agreement on Safety and Immunity Guarantees (JASIG) at patuloy na pagpiit sa mahigit 350 bilanggong pulitikal na idinetine batay sa mga gawa-gawang kasong kriminal na labag sa Comprehensive Agreement on Respect for Human Rights and International Humanitarian Law (CARHRIHL) at doktrinang Hernandez hinggil sa mga kasong pulitikal sa partikular.


Sa kabila ng lahat ng usaping nabanggit, naniniwala ang NDFP na umiiral pa rin sa esensya ang negosasyong pangkapayapaan dahil wala namang panig na tumapos na sa JASIG at ang totoo'y mayroong 12 pormal na kasunduan ang dalawang panig na nananatiling may bisa at umiiral; ang Joint Secretariat ng Joint Monitoring Committee ng CARHRIHL ay patuloy na nagtatrabaho sa Quezon City; ang mga panel ng magkabilang panig ay pinahihintulutan ng Ground Rules na makipagkonsultahan anumang oras; at ang tagapamagitang Norwegian ay tumatawid-tawid sa dalawang panel. Hindi na nagkaroon ng pormal na usapang pangkapayapaan ang dalawang panel sa negosasyon mula pa noong Pebrero 2011. Gustung-gusto ng NDFP na ipagpatuloy ang gayong mga pormal na usapan at bukas itong magpulong ang mga pangkat ng mga negosyador at magkonsultahan upang bigyang daan ang pormal na usapan.


Patuloy na umaasa ang NDFP na tutupad ang GPH sa JASIG at CARHRIHL bilang  obligasyon at maipagpapatuloy ang mga pormal na negosasyong pangkapayapaan sa pagitan ng dalawang panel upang mapag-usapan ang tatlong nalalabing paksa sa subtantibong adyenda at magkakasunod itong mapagkasunduan. Ang mga ito ay ang a) mga repormang panlipunan at pang-ekonomya, b) mga repormang pulitikal at konstitusyunal at k) pagwawakas ng labanan at dispusisyon ng mga pwersa. Patuloy na iniaalok ng NDFP ang ispesyal na proseso ng pagpapairal ng kagyat na tigil-putukan at alyansa sa pagitan ng GPH at NDFP matapos mapirmahan ang isang pangkalahatang deklarasyon ng komun na layunin habang patuloy pang hinaharap ng regular na proseso ng negosasyong pangkapayapaan ang tatlong nalalabing paksa.


Ang pangkalahatang deklarasyon ng komun na layuning ipinanukala ng NDFP ay bagay na di maaaring tutulan ng sinumang Pilipinong patriyotiko at naghahangad ng demokrasya. Sinasaklaw nito ang mga layuning tulad ng pagtataguyod sa pambansang soberanya at kalayaan at pagwawaksi sa mga di pantay na tratado, kasunduan at aregluhan; pagpapalawak ng demokrasya sa pamamagitan ng ilang mekanismo upang bigyang-kapangyarihan ang masang anakpawis at panggitnang uri; pagpapatupad ng programa ng pambansang industriyalisasyon at reporma sa lupa; pagpapaunlad ng  patriyotiko, syentipiko at makamasang edukasyon at kultura; at pagtataguyod ng independyente at aktibong patakarang panlabas para sa kaunlaran at pandaigdigang kapayapaan.


Kung tunay na interesado ang administrasyong Aquino sa pagpapabilis ng regular na proseso ng pagpapairal ng kapayapaan sa pamamagitan ng pagpapairal ng tigil-putukan, walang dahilan para antalain ang katuparan ng panukala ng NDFP hinggil sa ispesyal na proseso para sa alyansa at tigil-putukan alinsunod sa pangkalahatang deklarasyon ng komun na layunin, lahat para sa kapakinabangan ng sambayanang Pilipino.


Hinikayat ko ang presidente mismo ng GPH na magkaroon ng pampulitikang kapasyahan na gampanan ang kanyang krusyal na papel upang magtagumpay ang regular at ispesyal na proseso. Lagi't laging handa ang NDFP na makipagpulong sa mga ispesyal na kinatawan ng GPH hinggil sa ispesyal na proseso upang higit na ayusin ang mga kundisyon para sa negosasyong pangkapayapaan at mapabilis ang mga pagsisikap na resolbahin ang mga ugat ng armadong tunggalian at mailatag ang batayan para sa makatarungan at pangmatagalang kapayapaan. Tukuyin natin ang komun na pampulitikang batayan at agad tayong magtulungan para sa kapakinabangan ng mamamayan.

MILF holds peace advocacy in Sultan Kudarat


September 16, 2012 News: The political committees and military units of the Moro Islamic Liberation Front (MILF) organized a joint peace advocacy program at Barangay Malisbong in Palimbang, Sultan Kudarat Province.

This takes place today with hundreds of participants in attendance from the provinces of the Sultan Kudarat and Saranggani.

Members of the MILF Coordinating Committee on the Cessation of Hostilities (CCCH), Team Site 4 of the International Monitoring Team (IMT), MILF leadership join the program.

“This joint program of the MILF political committee and BIAF is for the purpose of explaining the recent progress on the peace negotiation between the Government of the Philippines (GPH) and MILF,” conveyed the MILF Political Officer of Biwang Provincial Committee.

“We are properly aware of the status of the peace talks but this gathering is to advocate support for the peace process and provide opportunity for our people from the ground to appreciate correctly the recent development of the talks between the two parties being facilitated by Malaysia,” he said.

He also gave the assurance of their full support and cooperation to whatever decision the MILF Central Committee will take on the peace talks.
