Army reaffirms adherence to International Humanitarian Law
FORT BONIFACIO, Taguig City – In a
simultaneous flag raising ceremony in all military camps nationwide on
Monday, August 13, Army personnel took an oath of reaffirmation to
strictly adhere to International Humanitarian Law (IHL), an Army
official said.
Major Harold M Cabunoc, the Army
Spokesperson, said that the Philippine Army joins the whole nation, as
well as the international community, in celebrating the IHL Day. Mr.
Jean-Luc Metzker of the International Committee on Red Cross (ICRC) and
Army Chief Lt Gen Emmanuel T Bautista graced the event.
IHL Day is observed to commemorate the
signing of the 1949 Geneva Conventions which is considered the core of
the International Humanitarian Law. It has been acceded by 194 States,
the Philippines included.
The Philippine Army, for its part,
continues to adopt measures in furtherance of its commitment to respect
and uphold human rights at all times.
“Army Chief Lt Gen Emmanuel T Bautista
has directed all commanders of the Army’s major units all throughout the
archipelago to strictly observe human rights protection in the conduct
of operations, be it combat, intelligence or civil military operations,”
said Cabunoc.
In his statement, Bautista said that the
celebration of IHL Day is a reaffirmation of the Philippine Army’s
commitment and support for the International Humanitarian Law as it
performs its role of protector of the people and the state.
“Let me remind all of you that while the
use of force may be necessary to address armed threats to our nation’s
peace and security, we have to bind ourselves to certain rules of
conduct in adherence to international humanitarian law and human rights.
And despite the fact that we are facing adversaries that abide by no
rules, we must remain by the rule of law. That is what makes us
different from those we fight,” said Bautista.
Human rights protection is an integral
component of the IPSP Bayanihan. Bautista said that reaffirmation to the
principles of human rights and international humanitarian law is a
significant step towards winning peace based on the rights and dignity
of every individual.
“As we renew and reaffirm our adherence
to the International Humanitarian Law, I encourage every soldier to take
this to heart and exert conscious effort to abide by its wisdom in all
our undertakings. This will be key to winning the peace and achieving
our vision to be a world-class army that is a source of national pride,”
concluded Bautista.
Meanwhile, various activities are lined up for this year’s celebration which is led by the Department of National Defense (DND).
One of the highlights of the celebration
is the Photo Exhibit at the Philippine Army Wellness Center (Army Gym)
which will run from August 13 to 17.
On August 18, participants from other
government agencies, non-government organizations, and people’s
organizations are expected to join the IHL Advocacy Run. The run will be
held at the Mc Kinley – Fort Bonifacio – Heritage Park area.
Also, a bloodletting activity to be facilitated by the Philippine National Red Cross will be conducted at the HPA Grandstand.

European Minister Sees Capacity-Building for AFP

GENERAL EMILIO AGUINALDO, Quezon City – A possible capacity-building
assistance for the Armed Forces of the Philippines’ (AFP) Human Rights
efforts is seen by European Parliament member, Norica Nicolai who met
with AFP Human Rights Office (AFPHRO) Chief, Brig. Gen. Domingo J.
Tutaan Jr. along with other Key Military Officials, Tuesday at the AFP
General Headquarters, here.
Nicolai expressed her enthusiasm for
future cooperation and assistance for the AFP after validating on-going
efforts of the military in addressing Human Rights issues among its
ranks.
Brig. Gen. Tutaan led the activity by presenting
the various reforms the AFP has instituted in order to promote a human
rights-protective culture in the defense and security sector. He was
accompanied by Representatives from the AFP Office of the Deputy Chief
of Staff for Civil-Military Operations, Office of the Deputy Chief of
Staff for Operations, Office of the Deputy Chief of Staff for
Intelligence, and the AFP Judge Advocate General, Col. Marian Aleido.
“It
surprised us that Madame Nicolai was already well-aware of our efforts
in promoting and protecting the Human Rights (HR), and all our
undertakings on the adherence to the International Humanitarian Law
(IHL), and the Rule of Law (ROL). This indicates that the AFP’s
‘HR-IHL-ROL’ advocacies have already reached the international community
thus opening our windows for more possible avenues for assistance and
collaborations,” Brig. Gen. Tutaan said.
Nicolai who recently
expressed interest to call on several Philippine officials to discuss
certain aspects of the Philippine – European Union (PH-EU) relations is
also the Rapporteur on the Ratification of the PH-EU Partnership and
Cooperation Agreement (PCA).
On the other hand, Undersecretary
Severo S. Catura, Executive Director of the Presidential Human Rights
Committee (PHRC) under the Office of the President has expressed that
the meeting indicates well to the partnership the Philippines has with
the EU on matters delving on human rights, and may also pave the way for
future cooperation and capacity building efforts for the AFP.
Aside
from AFP’s efforts to address human rights issues, and its adherence to
the International Humanitarian Law and Rule of Law, BGen Tutaan
presented the AFPHRO’s ongoing programs relative to education and
training, publications, foreign exposure, and other cooperation with the
EP on HR-IHL-RoL matters.
Strengthening of the AFP Human Rights Office
The
AFP is continuously strengthening its Human Rights Office which has
been replicated to all levels of commands; from the division, brigade,
and down to the battalion level in order to address human rights issues
and concerns.
In pursuit of effectively and efficiently addressing human rights violation cases being reported to the AFP, the military has undergone significant reforms anchored with its new campaign plan, the IPSP Bayanihan.
The AFPHRO has been consistent in its campaign
programs pertaining to HR-IHL-RoL. This is reflected in the advocacy
lectures and seminars about the Universal Declaration of Human Rights,
and other international human rights bills being conducted regularly by
the AFPHRO amongst soldiers particularly those assigned in the field.
Human Rights Advocacy Education and Training within AFP Members
The
AFP through the HRO is also very active in teaching AFP personnel
assigned in garrisons and in the field about local laws pertaining the
Human Rights. The AFPHRO has also been closely coordinating with other
government agencies, human rights advocacy groups and Local Government
Units (LGUs) to spread the military's advocacy on Human Rights.
The
Office continuously conducts a series of advocacy and training seminars
in all AFP area commands and units in the field. The seminars are
focused on raising the awareness as well as informing soldiers about the
principles of the Comprehensive Agreement on Human Rights and
International Humanitarian Law (CAHRIHL). It also teaches the soldiers
about the proper process of filing complaints against the enemies who
committed violations of this agreement.
Human Rights courses and
modules are also being taught as pre-entry courses to civilians who
intend to join the military. This is also done in military schooling and
is taught at the AFP Command and General Staff College (CGSC), one of
AFP’s premier training institutions tasked to train senior leaders and
key officers who are about to take or assume command and sensitive staff
positions in the AFP.
Meanwhile, the AFP Chief of Staff sees the meeting as an advantage for the military organization’s part.
“We
see this as another avenue for us to expound and reaffirm our
commitment towards the protection and promotion of Human Rights, and
adherence to the International Humanitarian Law and Rule of Law. The AFP
recognizes that the respect for human rights is at the core of the
Internal Peace and Security Plan (IPSP) Bayanihan. In order for our
soldiers to be guided with the right values and advocacy, the military
continues to invest extensively in human rights,” AFP Chief of Staff,
Gen. Jessie D. Dellosa said.

MILF organizes groups to explain the Framework Agreement on the Bangsamoro
Members of the MILF number several hundreds of thousands throughout Mindanao, Sulu, Tawi-Tawi, and Palawan.
Sheikh Mohammad Muntassir, head of the Da’wah Department of the MILF, told Luwaran that the six groupings are given their respective assignments as follows: Sulu-Tawi-Tawi-Basilan, the Zamboanga Peninsula, the Lanao area, the Davao area, Maguindanao-Cotabato area, and South Cotabato area.
He disclosed that members of the MILF Central Committee were assigned and distributed to the six groupings and will be the lead discussants.
Earlier, however, senior members of the MILF Central Committee and members of the MILF Peace Panel held a one-day forum on the Agreement.
Mohagher Iqbal, MILF chief peace negotiator, told Luwaran that understanding the Agreement is not easy, saying that it contained provisions that are constructed ambiguously to give both parties elbow rooms or space for movement; "room to pass"; or "make way for".
He added that sometimes the rigidity of meaning in literal construction is posing serious problems to both sides in trying to address the concerns of special audiences.
Meanwhile, some 600 MILF political and military leaders including some MNLF foreign-trained commanders attended the one-day seminar in Darapanan, Sultan Kudarat, Maguindanao last October 31. Most of the senior leaders of the MILF led by Chairman Al Haj Murad Ebrahim attended the forum.
Sulu and Tawi-Tawi are fast becoming an MILF territory as more and more individuals and groups are joining the MILF after signing of the Framework Agreement.
One former MNLF leader described the Agreement as “amazing” and “historic”.

The Communist Party of the Philippines (CPP) denounced the memorandum of agreement between the Philippine National Police (PNP) and the New York Police Department (NYPD) signed last Wednesday as "part of heightening US government intervention in the Philippines."
The CPP further said that "the agreement with the US NYPD, one of the most notorious fascist police organizations in the world, can only lead to worse human rights abuses by police operatives under the Aquino regime," said the CPP.
The MoA was signed by PNP Chief Nicanor Bartolome and the head of the NYPD's Singapore satellite office Lt. Gustavo Gutierrez. The purportedly calls for "cooperation in addressing transnational crimes" and "capacity building and training" between the PNP and the NYPD. According to information earlier released by the PNP, the NYPD will open a satellite office inside the PNP's general headquarters in Camp Crame.
"The PNP-NYPD MoA will only serve as an additional legal cover for the US government's heightening intervention in the Philippines. It will lead to more extensive and intrusive intelligence and other types of operations by US police and military agents in the country," said the CPP.
"Even before the MoA, US police and federal agents have already been operating in the Philippines clandestinely with the cooperation of the local police." The CPP pointed out that political prisoners detained at the PNP Custodial Center in Camp Crame were able to uncover the presence of agents of the US Federal Bureau of Investigation (NBI) maintaining their own offices within the camp and in a condominium unit nearby.
Several Indonesian nationals accused of being "terrorists" and arrested by US agents in Indonesia and Malaysia have been renditioned by the US government and given false Filipino identities at the behest of the NBI to justify their detention at Camp Crame. This is in violation of Philippine national sovereignty and the Indonesian detainees' human rights, added the CPP.
"The NYPD is notorious for being a fascist tool of suppression against the American people," said the CPP. "Recently, the NYPD was employed in the suppression of protest actions at Zucotti Park near Wall St. by American workers, students and ordinary people against the pro-big monopoly policies of the American government."
"In investigations carried out by human rights and law groups, the NYPD was found to have used excessive police force, and guilty of hundreds of other violations, including unjustified arrests, abuse of journalists, unlawful closure of sidewalks and parks to protesters, and pervasive surveillance of peaceful activists, said the CPP.
"Following the pattern of its new partner, the PNP is bound to become even more brutal in dealing with protests, urban poor anti-demolition barricades and other mass actions," said the CPP.
